Plain version: this site is the catalogue. Buying happens on Depop, eBay, Whatnot, or TikTok Shop, so their checkout, their protection, their rules apply to the purchase itself. What's below is how I describe and handle the goods, wherever you buy them.
Where the sale actually happens. talkingwear.com does not take payments. Every buy button sends you to that item's listing on a marketplace, and the contract of sale, payment processing, shipping terms, returns window, and buyer protection are governed by that marketplace's terms — not by this page. This page covers how the goods are described, graded, and checked for safety.
TalkingWear is an independent secondhand clothing seller operating from Gilbert, Arizona, United States ("TalkingWear", "I", "me"). Contact: hello@talkingwear.com. Placing an order on talkingwear.com means you accept these terms.
You must be 18 or older to buy, or have a parent or guardian complete the purchase for you.
Every item is pre-owned and sold as-is unless the listing explicitly says "new with tags". Used clothing carries wear. I grade each piece, photograph flaws rather than hide them, and list measurements laid flat in inches. Vintage sizing rarely matches modern sizing — the measurements govern, not the tag.
Colours vary between screens. Measurements are taken by hand and are accurate to roughly half an inch.
Items are washed or cleaned before shipping unless the listing says otherwise. Cleaning is not a guarantee of sanitisation; launder anything you receive before wearing it, as you would with anything secondhand.
Brand names appear on this site solely to identify secondhand goods. TalkingWear is not affiliated with, sponsored by, endorsed by, or authorised by any brand named here, nor by Depop, eBay, Whatnot, TikTok, Poshmark, or any other marketplace. All trademarks belong to their owners.
I do not knowingly sell counterfeit goods. Where a label cannot be verified, the item is listed as unbranded rather than guessed at. If you receive something you have reason to believe is not authentic, contact me and I will refund it in full, including shipping, and I will want the information so I can stop selling anything else from that source.
It is unlawful in the United States to sell a recalled consumer product. Before listing, I check items against current recalls and against the safety issues that most often affect used clothing:
If you believe something I sold you is unsafe or has been recalled, stop using it and contact me. I will refund it. You can also check recalls yourself at cpsc.gov/Recalls and report a hazard at saferproducts.gov.
Prices are in US dollars and can change at any time before you complete checkout. Listings are one-of-one: there is exactly one of each piece.
Pieces are frequently listed here and on Depop, eBay, Whatnot, or TikTok Shop at the same time. The first completed payment takes the item, wherever it happens. I pull the listing from every other platform the same day. If two people pay for the same piece within minutes of each other, the second order is refunded in full and immediately, with no argument and no restocking charge. That is the trade-off for cross-listing and I wear the cost of it, not you.
I reserve the right to cancel and refund any order in full — for example if a piece is damaged in storage, or if a listing carries an obvious pricing error.
Sales tax on your purchase is calculated, collected, and remitted by the marketplace you bought through. Under marketplace facilitator rules, Depop, eBay, Whatnot, and TikTok Shop are responsible for that on sales made through their platforms. Nothing on this site collects tax, because nothing on this site takes payment.
Arizona levies a Transaction Privilege Tax (TPT) rather than a conventional sales tax. It is a tax on the seller for the privilege of doing business in the state, which sellers are permitted to pass on to the buyer. Where TPT or another state's sales tax applies to your order, it is calculated and added at checkout and shown before you pay.
Purchases you make through Depop, eBay, Whatnot, or TikTok Shop are handled differently: those marketplaces collect and remit tax on those transactions themselves under marketplace facilitator rules, so the tax you see there comes from them, not from me.
Pay inside the marketplace app, always. That is what gives you their buyer protection, and it is the only way I accept money.
I will never ask you to pay by Zelle, Venmo, Cash App, PayPal friends-and-family, gift card, cryptocurrency, or wire transfer, and I will never ask you to complete a purchase off-platform. Anyone messaging you claiming to be TalkingWear and asking for that is not me — report them to the marketplace and email me so I know.
Card payments are processed by Stripe. Your card details go directly to Stripe and are never seen by, transmitted through, or stored by TalkingWear or this website.
I will never ask you to pay by Zelle, Venmo, Cash App, PayPal friends-and-family, gift card, cryptocurrency, or wire transfer. Anyone contacting you claiming to be TalkingWear and asking for payment that way is not me. Email me and I will confirm it.
Shipping is arranged through the marketplace you bought on, using their label and their tracking, on their stated timescales. I pack and post within 2 business days. Delivery problems are raised through that platform, which is also where your protection sits — but message me too and I will chase it with you rather than leave you to it.
Local pickup in the Gilbert area can sometimes be arranged. Ask before you buy, and understand that pickup means the marketplace's buyer protection may not apply.
Returns follow the policy of the marketplace you bought through, and their window and process take precedence over anything here. On top of that, the promise below applies wherever you bought it.
All sales are final, with one exception that I take seriously.
Not as described. If an item arrives with a flaw I failed to disclose, in a size other than the one listed, or damaged in transit, email me within 3 days of delivery with photos. I will refund you in full, including original shipping, or replace the item — your choice. I pay return postage where a return is needed.
This is your right regardless of anything else in these terms, and nothing here limits any consumer protection you have under federal or Arizona law, or any protection the marketplace you bought through gives you.
Not covered: changing your mind, fit that does not suit you, colour that differs from your screen, or wear consistent with the stated condition grade. Measure something you already own and compare it to the listed measurements before buying — I will happily re-measure anything on request.
Don't scrape it, don't copy the photographs or written descriptions for your own listings, and don't attempt to interfere with the site or the checkout. Photographs and written descriptions on this site are my own work and are not licensed for reuse.
Beyond the not-as-described protection above and any rights you have under applicable law, secondhand goods are supplied as-is without warranties of merchantability or fitness for a particular purpose. My total liability for any order is limited to what you paid for it, including shipping. Nothing in these terms excludes liability for fraud, misrepresentation, personal injury caused by negligence, or anything else that cannot lawfully be excluded.
Email me first. Most things get fixed the same day. If we can't resolve it between us, these terms are governed by the laws of the State of Arizona, and any dispute goes to the state or federal courts of Maricopa County, Arizona. There is no forced arbitration and no class-action waiver here — you keep every option you would otherwise have, including small claims court.
These terms may be updated. The version that applies to your order is the one published on the day you place it. Material changes will be dated at the top of this page.
